| The
Privacy Amendment (Private Sector) Act
2000 |
The new
Australian private sector privacy legislation, entitled The
Privacy Amendment (Private Sector) Act 2000, came into effect
on 21 December 2001. This legislation includes strict
procedures for the manner in which organisations collect and
manage personal and sensitive information. These procedures
are based on 10 National Privacy Principles (NPPs), which
represent the minimum acceptable standard under the
legislation. The National Privacy Principles established by
the Privacy Act 1988 apply to Clexan-Peak
Personnel.
Types of Personal Information Held
Personal
information is any information or an opinion about an
individual. It may range from the very sensitive (e.g. medical
history or condition) to the everyday (e.g. address and
telephone number). The personal information that
Clexan-Peak Personnel will collect and hold
usually falls into the following categories:
- Candidate information submitted and obtained from the
Candidate and referees in connection with applications for
work;
- Work
performance information;
- Information about incidents in the workplace;
- Staff
information concerning in-house office employees;
- Employment records, including information submitted
and obtained in relation to absences from work due to leave,
illness or other causes.
Purposes for which Clexan-Peak Personnel
Hold Personal Information
Clexan-Peak Personnel hold personal
information for the following reasons:
- Placement operations
- Recruitment
- Staff
management
- Training
- Client
and business relationship management.
Disclosures
Clexan-Peak Personnel may disclose an
individual's personal information for the purposes for which
it is primarily held or are under a legal duty to do so.
Updating Information
To ensure
the Candidate is given the best possible chance of securing
employment it is crucial that all records are keep up-to-date.
It is therefore the responsibility of the individual to
contact Clexan-Peak Personnel and notify of them
of any changes to their personal information.
Enquiries and Complaints
An
individual can make further enquiries or complaints about this
privacy policy to the Clexan-Peak Personnel

Access
Subject to
some exceptions that are set out in the National Privacy
Principles, an individual can gain access to the personal
information that an organisation holds about them.
Clexan-Peak Personnel will refuse access
if it would interfere with the privacy rights of other persons
or if it breaches any confidentiality that is attached to that
information.
If an
individual seeks to obtain access to their personal
information they should contact the Privacy Co-ordinator. The
individual will need to be a position to verify their
identity.
